This session will discuss several visa options for foreign-born employees, pitfalls to avoid when your employees travel overseas, and opportunities for workers created by President Obama’s executive actions on immigration. First, we will briefly discuss the popular H-1B visa. Because the visa has become controversial due to employer outsourcing of jobs, and because there are too few visas to fulfill the demand, we’ll look briefly at alternative visas for multinational employees and for employees of extraordinary ability. Next, we’ll touch on common overseas travel issues: what happens to an employee who travels on an expiring passport, and whether a waiver may be required to re-enter the U.S. if your employee has had a brush with the law. Finally, we’ll discuss options for a different set of workers: people who qualify for work permits under President Obama’s executive action for undocumented youths who grew up in the U.S. Some of these workers may qualify for a green card if they are married to a U.S. citizen and travel abroad and re-enter the U.S. with permission. Finally, we’ll discuss legal developments in President Obama’s proposed executive action to grant work permits to the parents of U.S. citizens, which may be before the Supreme Court next year.
