Effective July 1, 2015, the new Healthy Workplaces, Healthy Families Act will require most employers in California to give at least three paid sick days per year to most employees, including temporary and part-time personnel. For a seemingly simple concept, this new law raises a handful of issues concerning the accrual rate, carryover of unused sick leave, and how it applies to PTO policies. Sick days can also be used by employees who are victims of domestic violence, sexual assualt, or stalking, and for illnesses of family members. Stringent anti-retaliation provisions and monetary penalties create new risks of liability for the employer. The law also requires record-keeping, and a new poster in the workplace. Even employers who already offer three or more days of sick leave or PTO need to review their policies for compliance. This program will provide a comprehensive overview of the new law, with practical guidance on the best practices for adminstering sick leave and PTO policies.
