PAGA claims are on the rise. They can result in massive liability, for even the most minor technical violations. A relatively recent California Supreme Court decision has resulted in unleashing a flood of PAGA claims. While the California legislature recently passed a law to curb PAGA claim abuse, the legislation did not even make a dent. PAGA claims can be brought by a single employee on behalf of him/herself and other aggrieved employees without establishing the criteria required for a class action. Many HR Professionals are unaware of what PAGA is, what it covers and what they can do to minimize exposure. PAGA claims cover hundreds of Labor Code violations, including working conditions, wage and hour, health and safety, lawful off- duty conduct and more. This presentation would educate HR professionals about the ins and outs of PAGA, provide an overview of the Labor Code sections that give rise to PAGA claims and provide useful tools to utilize going forward.
