Jonathan Light will discuss over 30 scenarios involving employee leaves of absence, drawn from real life business experiences with California employers, from interaction among FMLA, CFRA, PDL, PFL and SDI for pregnancy leave situations to dealing with the chronically absent employee following exhaustion of FMLA leave.
Discussion scenarios include:
• The employee who repeatedly provides a doctor's note just before being scheduled to return to work
• How to find a replacement without getting sued
• How long an employer must hold a position open
• The interaction of multiple leave laws during pregnancy and related baby bonding
• Strategies for warning or disciplining employees who have gone on or are returning from leave
• Strategies for encouraging poorly performing employees not to return
• Handling return-to-work issues when employees continue to be disabled
• The documentation necessary to support the actions taken by the employer.
The presentation will address the application of the ADA and related state law as they interact with other California and federal leave laws, all applicable to California employers. The presentation assumes basic knowledge of the subject matter.
