California Doesn't "Leave" It Alone: Another Major New Leave Law

Brian K. Nagatani co-founded Hixson Nagatani LLP in 2008. Mr. Nagatani has an active counseling and litigation practice. He provides preventive counseling to employers on a number of employment-related issues. Mr. Nagatani has defended court lawsuits involving numerous claims including discrimination, harassment, wrongful termination, fraud, and breach of contract. He also has experience defending both single plaintiff and class action lawsuits involving alleged wage and hour violations. Mr. Nagatani has presented legal seminars sponsored by various organizations including PIHRA, and also frequently conducts on-site legal compliance training sessions for clients. Mr. Nagatani graduated from Columbia University School of Law in 2000. Prior to law school, Mr. Nagatani attended the University of California at Berkeley where he earned a B.A. degree with Honors in Political Science in 1997. Mr. Nagatani is in his 14th year of coaching the mock trial team at Cupertino High School. Mr. Nagatani has received the highest Martindale-Hubbell peer rating, “AV” preeminent (5.0 out of 5.0). Martindale-Hubbell describes this as “a significant rating accomplishment – a testament to the fact that a lawyer’s peers rank him or her at the highest level of professional excellence.”

Description
Once again, California employers enter the new year with another major new leave law with which to contend: the New Parent Leave Act. This session will cover details of the NPLA, as well as updates employers must make to their policies and leave forms to accommodate the new law. We will also cover key differences between the NPLA and FMLA/CFRA and why employers cannot simply rely on FMLA/CFRA policies and leave forms to comply with the NPLA (as well as why certain employers may now be covered by both the NPLA and FMLA/CFRA).
Although the majority of the session will be devoted to the NPLA, we will also cover recent court decisions involving additional leave issues including: How much is too much disability leave? ~How did a California employer interfere with an employee's leave for gender reassignment surgery? Finally, since sick leave compliance continues to be a hot topic, we will cover key issues to ensure compliance with the sick leave law.
