This program will explore common provisions in employment documents and the dangers that may be lurking within. The panelists will offer best practices for revising employment documents and provide templates that will stand up in court. Examples of the “boilerplate” provisions to be addressed include choice-of-law, forum selection, waivers, confidentiality, non-disparagement, forever-gone, integration, severability, and survival clauses -- often standard provisions in various types of employment-related agreements, such as employment offers and contracts, nondisclosure and confidentiality agreements, non-compete/non-solicitation agreements, and employment separation agreements. Often these routine provisions are just recycled from one contract to the next and may in fact create, rather than eliminate, legal risks.
