How COVID-19 is Affecting Reasonable Accommodations

Our presentation will address how
Covid-19 has impacted reasonable accommodations and the interactive
process. We will discuss what the law requires when an employee is
diagnosed with Covid-19, different kinds of reasonable accommodations
that could be appropriate, requested accommodations that are not
required on the grounds that they would pose an undue hardship to the
employer, and what the undue hardship analysis entails. We will go over
the “interactive process”, when it must take place, what is and is not
required by an employer, and the appropriate documentation.
We will also address the interplay between employment accommodation and workers compensation claims as it relates to Covid-19, and how to avoid traps from employees. We will go over various fact patterns, and discuss the best steps the employer may take.
