How COVID-19 is Affecting Reasonable Accommodations

Our presentation will address how
Covid-19 has impacted reasonable accommodations and the interactive
process. We will discuss what the law requires when an employee is
diagnosed with Covid-19, different kinds of reasonable accommodations
that could be appropriate, requested accommodations that are not
required on the grounds that they would pose an undue hardship to the
employer, and what the undue hardship analysis entails. We will go over
the “interactive process”, when it must take place, what is and is not
required by an employer, and the appropriate documentation.
We will also address the interplay between employment accommodation and workers compensation claims as it relates to Covid-19, and how to avoid traps from employees. We will go over various fact patterns, and discuss the best steps the employer may take.

Ryan Kohler is an attorney that works extensively on issues of employment, contracts, professional liability, and claim defense. He has worked extensively with employers and defended them in trials, arbitrations, and administrative hearings. He counsels clients to help minimize the risk of workplace claims through educating managers, informing principals of legal trends and changes to the law, drafting employee handbooks, providing harassment seminars, advising on terminations and discipline, and litigating employment law issues before the courts and administrative agencies. He has recently published articles on the impact of AB-5 to California employers and the obligations of employers under the new federal Families First Coronavirus Response Act.
Robert Yap’s practice focuses on business/commercial

employment, and personal injury claims. He has litigated multiple cases
to trial and binding arbitration, and successfully argued before the
California Court of Appeal and the Ninth Circuit Court of Appeals. He

from 2015 – 2019.
