California may not have a stand-alone statute for drug testing, but it is one of the most active states for precedent-setting case law affecting drug testing. This causes some confusion among employers who may be tempted to question if workplace drug testing is even legal. The good news is, yes, workplace drug testing is legal in the Golden State but due to a plethora of court rulings many conditions, restrictions, and cautions apply.
