California Law and the Legal Defensibility of Drug Testing
presented by William Current
California may not have a stand-alone statute for drug testing, but it is one of the most active states for precedent-setting case law affecting drug testing. This causes some confusion among employers who may be tempted to question if workplace drug testing is even legal. The good news is, yes, workplace drug testing is legal in the Golden State but due to a plethora of court rulings many conditions, restrictions, and cautions apply. Legal defensibility should be every California employer’s number one priority when it comes to maintaining an effective drug testing program.
Learning Objectives include:
1. California case law decisions that have a direct impact on who can be tested and when and how.
2. How to build a legally defensible drug testing program by following the guidelines included as part of the only three federally endorsed drug testing methods—lab-based urine, oral fluid and hair testing.
3. How best to address marijuana use by applicants and employees, and what California employers can do with a positive test result.
4. Measuring drug testing return-on-investment in the new normal for drug testing.
