SB 1383: Expanding Leave Rights
Under the Family Rights Act
presented by Jessica J. Mead, Esq. &
Robert R. Yap, Esq.
SB 1383’s expansion of California Family Leave Rights Act not only effects large employers who were previously subject to the law, but also immensely impacts small employers. Our presentation will go over what is required of employers when an employee makes a leave of absence request under both California and Federal law. We will explain the major changes in the new California Family Rights Act, which became effective January 1, 2021. We will discuss how the new CFRA applies to substantially more employers, expands the number of employees who are eligible for CFRA leave, and grants employees additional bases for which CFRA leave may be used.
In addition to highlighting the recent changes in the law, our presentation will address the implications raised by the new law, including that employers now may be required to provide 24 weeks of leave in a year. We will go through the consequences of violating the CFRA and potential remedies that may be available to eligible employees whose leave requests are improperly denied. By the end of the presentation you will have a solid understanding of how the new CFRA substantially expands the former law as well as what steps your company can take to ensure that leave policies align with the CFRA expansion.
